“Stripes to Austin” Promotion Official Rules

 

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING. 

 

DATES OF PROMOTION:  The “Stripes to Austin” Promotion (the “Promotion”) begins at 12:00 a.m. Eastern Time (“ET”) on June 27^th, 2024 and ends at 11:59:59 p.m. ET on July 15, 2024 (the “Promotion Period”).  All times in these Official Rules shall be United States Eastern Time (ET).

 

ELIGIBILITY: The Promotion is open to legal permanent residents residing in the contiguous forty-eight (48) United States or the District of Columbia who are at least eighteen (18) years of age or older at the time of entry (the “Entrant”).  Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of (a) Club de Futbol Monterrey Rayados, A.C. (“Sponsor”) or any of its affiliates, and each of their respective franchisees, affiliates, contractors, consultants, legal counsel, public relations representatives, distributors, sales representatives and retailers, (b) National Sweepstakes Company, LLC (the “Independent Administrator”), or (c) any website providers, webmasters, advertising or promotional, fulfillment, or marketing agencies, and any others engaged in the development, production, execution or distribution of the Promotion (collectively referred to herein as “Promotion Entities”), are not eligible to participate in the Promotion. The Promotion is void outside of the contiguous forty-eight (48) United States, District of Columbia and wherever else restricted or prohibited by law.   Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor and Independent Administrator’s decisions, which are final and binding in all matters related to the Promotion.

 

TO ENTER: To enter, download the Rayados mobile app (www.rayados.com/app/) (the “App”) and register to receive one (1) entry into the Promotion. The App is a free app available in the Apple App Store (for iOS devices) and Google Play (for Android devices). Upon successful registration on the App, an Entrant will automatically be entered into the Promotion. All entries must be submitted during the Promotion Period to be considered a valid entry.

Standard messaging and data rates apply. Entrants entering the Promotion via mobile may be charged standard data rates of the service agreement with his/her wireless carrier.  Each wireless carrier’s rate plan may vary, and Entrants should contact their wireless carrier for information on rate plans and charges relating to the participation and entry in the Promotion.  Entrants are solely responsible for any such wireless charges.  Mobile web browsing capabilities may be limited and may not be available through all wireless carriers.  Entrant must check with his/her service provider or refer to their service contract for complete details, availability and coverage, along with a description of the applicable charges. Not all wireless carriers participate. 

Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different identities, email addresses registrations, logins, and/or any other methods, including, but not limited to, automated entry, will void that Entrant’s entry and that Entrant may be disqualified from the Promotion. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the person in whose name the e-mail account is registered (“Authorized Account Holder”).  The Authorized Account Holder is the natural person who is assigned to the e-mail address by an internet access provider, on-line service provider, or other organization that is responsible for assigning e-mail addresses, or the domain associated with the submitted e-mail address.  Potential Grand Prize Winner may be required to show proof of being the Authorized Account Holder. No mechanically or programmatically reproduced plays/entries are permitted.  Sponsor will not verify receipt of entries for Entrants.  All entries submitted become the sole property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, or incomplete entries. 

 

PRIZE: One (1) grand prize (the “Grand Prize”) of a trip for the grand prize winner (“Grand Prize Winner”) and one (1) guest to Austin, TX for a soccer game experience on August 3, 2024. Grand Prize is inclusive of a two (2) night trip inclusive of: i) roundtrip coach class airfare to and from a major airport nearest the residence of the Grand Prize Winner and Austin, TX from August 2, 2024 to August 4, 2024, ii) two (2) night hotel stay at a hotel to be determined by the Sponsor (only inclusive of room and tax), and iii) two (2) tickets to the soccer game on August 3, 2024. The Approximate Retail Value (“ARV”) of the Grand Prize is $3,500.00.   

 

Travel must be taken on the dates specified above or the Grand Prize will be forfeited in its entirety and Sponsor will have no further obligation to Grand Prize Winner.

 

ARV of the Grand Prize may vary depending on point of departure and fare/rate fluctuations. Grand Prize is subject to certain restrictions and exact travel times and arrangements are subject to capacity controls, availability, blackout dates and certain other restrictions, all of which are subject to change. Travel must be roundtrip.  The difference between the ARV and the actual value of the Grand Prize will not be awarded.

 

If the Grand Prize Winner resides within a one hundred (100) mile radius of  Austin, TX (a “local resident”), in lieu of the roundtrip air transportation portion of the Grand Prize, Grand Prize Winner and guest may receive (as solely determined by Sponsor) round-trip ground transportation of Sponsor’s choice for Grand Prize Winner and guest from Grand Prize Winner’s residence to Austin, TX. No compensation will be awarded in lieu of the difference in the ARV for the Grand Prize for a local resident and the ARV for the Grand Prize who is not a local resident. Grand Prize Winner and his/her guest must be able to travel on dates to be determined by Sponsor. Exact dates of travel to be determined at Sponsor’s sole discretion. Sponsor may change travel dates at its sole discretion.

Grand Prize Winner and guest must travel together on the same itinerary. If the guest is under 18 years of age, guest must travel with a parent/legal guardian.  Guest must sign a liability/publicity release prior to issuance of any travel documents. Travel must be made through the Independent Administrator, on a carrier of their choice. Travel is subject to availability. Except as indicated, all meals, taxes, gratuities, travel insurance, room upgrade fees, bag check fees, parking fees, laundry service, food, alcoholic beverages, incidentals (including mini-bar), phone charges, merchandise, souvenirs and other expenses not specifically identified in these Official Rules are solely the responsibility of the Grand Prize Winner and guest. Grand Prize Winner and guest must comply with the check-in requirements, including, but not limited to, the presentation of a major credit card. All Grand Prize details are at Sponsor's sole discretion.

Grand Prize Winner and his/her guest must possess United States government-approved travel documents and be willing to sign any other legal documents required by Sponsor and/or Independent Administrator and travel on the same itinerary. The Promotion Entities are not responsible for any cancellations, delays, diversions or substitutions, or any act or omission whatsoever with respect to the Grand Prize.  All airline tickets issued in connection with the Grand Prize are not eligible for frequent flyer miles, upgrades and cannot be used in conjunction with any other promotion or offer.

 

No changes will be made to travel details of the Grand Prize once any element(s) of the travel arrangements have been booked, except at Sponsor’s sole discretion. Lost or stolen tickets, travel vouchers or certificates or similar items, once they are in Grand Prize Winner’s possession, will not be replaced. All airline tickets issued in conjunction with the Grand Prize are not eligible for upgrades. Any unclaimed and/or unused Grand Prize or element thereof will be forfeited and will remain the property of Sponsor. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth by Sponsor’s air travel prize supplier, as detailed in the passenger ticket contract issued by such supplier. In the event the Grand Prize Winner and/or his or her guest engage in behavior during travel and/or other applicable experience that (as determined by Sponsor in its sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to terminate the Grand Prize or other applicable experience early, in whole or in part, and send Grand Prize Winner and/or his or her guest home with no further obligation or compensation whatsoever to Grand Prize Winner or his/her guest. In the event Grand Prize Winner or guest engages in behavior during travel and/or other applicable experience that (as determined by Sponsor in its sole discretion) is illegal, tortious, or subjects Grand Prize Winner or guest to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by Grand Prize Winner or guest as a result of such conduct. Sponsor shall have no liability for any personal injuries, death, property damage, or other damages or expenses resulting from or arising out of any travel related to the GRAND Prize or any other aspect of Grand Prize Winner’s or Guest’s acceptance or use of the GRAND Prize.

 

PRIZE RESTRICTIONS: No prize substitution or cash alternative offered, except at Sponsor’s sole discretion or as otherwise provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if any portion of the prize becomes unavailable due to reasons beyond the control of the Sponsor.  Grand Prize is not transferable prior to award.  Any taxes imposed on the income of the Grand Prize Winner as a result of winning the Grand Prize and all other expenses not specifically mentioned herein as part of the Grand Prize are solely the responsibility of the Grand Prize Winner.  No more than the one () Grand Prize as set forth in these Official Rules will be awarded.  Any and all fees and expenses related to delivery, acceptance, and use of a prize not specifically identified in these Official Rules are solely the responsibility of the Grand Prize Winner. 

 

Total ARV of all prizes: $3,500.00.

 

DRAWING/ODDS: On or about July 16, 2024 a potential Grand Prize Winner will be selected from among all eligible entries received during the Promotion Period in a random drawing conducted by the Independent Administrator whose decisions are based upon their sole discretion and interpretation of these Official Rules and are final and binding in all respects. Odds of winning the Grand Prize are dependent upon the total number of entries received during the Promotion Period.

 

GRAND PRIZE CLAIM: Except where prohibited, potential Grand Prize Winner will be notified on or about July 16, 2024 via the email address or any other form of contact source provided at the time of registration (the “Notification”).  Potential Grand Prize Winner will be required to complete and return an affidavit of eligibility, liability/publicity release and W-9 form (collectively the “Paperwork”) within twelve (12) to twenty-four (24) hours of the Notification.  Potential Grand Prize Winner must return the Paperwork within the date and time indicated in the Notification. If the potential Grand Prize Winner fails to return the Paperwork within the date and time in the Notification, or is found to be ineligible, or if he/she does not comply with the Official Rules, such potential Grand Prize Winner and his/her entry will be disqualified and another potential Grand Prize Winner will be selected from the remaining eligible entries received, time permitting.   If the Notification is returned as undeliverable, this will result in disqualification and an alternate Grand Prize Winner will be selected, time permitting.   The value associated with the Grand Prize will be taxable as income and the Grand Prize Winner is solely responsible for any taxes, including, but not limited to all applicable federal, state and local taxes that become due with respect to the value of the respective Grand Prize. The Sponsor, or a third party acting on its behalf, must report the value of the Grand Prize to the Internal Revenue Service in the year the Grand Prize is received by the Grand Prize Winner and will be reported to the Grand Prize Winner and the Internal Revenue Service in the form of a Form 1099. In the event it is deemed during the verification process that the potential Grand Prize Winner does not have a unique, personal, and valid social security number for Sponsor (or any party acting on its behalf) to report the tax liability associated with acceptance of his/her Grand Prize, the potential Grand Prize Winner will be disqualified and another potential Grand Prize Winner will be selected from among the remaining non-winning eligible entries received during the Promotion Period.  Valid social security numbers will be determined by IRS requirements.

 

GENERAL CONDITIONS:  By participating in this Promotion, Entrants agree to be bound by these Official Rules and the decisions of the Promotion Entities, which are final in all respects and not subject to appeal.  Sponsor reserves the right to disqualify permanently from this Promotion any Entrant it believes has violated these Official Rules and verify eligibility of Entrants.  Neither Sponsor nor anyone acting on its behalf will enter into any communications with any Entrant regarding this Promotion, except as expressly set forth in these Official Rules. By participating in this Promotion, Entrants release the Sponsor and each and all of the Promotion Entities, from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Promotion, and/or the receipt or use/misuse of the prize awarded, including, without limitation, liability for personal injury, death or property damage.  Failure to comply with these Official Rules may result in disqualification from the Promotion.  All Promotion materials are subject to verification and are void if (a) not obtained in accordance with these Official Rules and through legitimate channels, (b) any part is counterfeited, altered, defective, damaged, illegible, reproduced, tampered with, mutilated or irregular in any way, (c) are obtained where prohibited, or (d) they contain printing, typographical, mechanical, or other errors.  Entrants assume all risk of loss, damage, destruction, delay or misdirection of Promotion materials submitted to Sponsor. In the event any portion of this Promotion is compromised by activities beyond the control of the Sponsor which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play of the Promotion or this Promotion, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Promotion. Winning the Grand Prize constitutes permission for Sponsor and its agencies to use Grand Prize Winner’s name, address (city & state), voices and/or likenesses for purposes of advertising, promotion and publicity, for this Promotion only, without further compensation, unless prohibited by law.  Sponsor may prohibit an Entrant from participating in the Promotion or winning the Grand Prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Promotion by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Promotion Entities. If for any reason this Promotion is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and randomly draw from those entries received up to the cancellation/suspension date to award the Grand Prize.  CAUTION: ANY ATTEMPT BY A PERSON TO UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

 

RELEASE: By participating in this Promotion, Entrants, and Grand Prize Winner agree to release and hold harmless Sponsor, Promotion Entities and each of their respective officers, directors, managers, employees, parents, subsidiaries, affiliates, agents, members, shareholders, insurers, servants, divisions, predecessors, successors, representatives, dealers, distributors, advertising, promotion, and fulfillment agencies, consultants and legal advisors (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt, redemption or use or misuse of any prize.

LIMITATIONS OF LIABILITY:  The Released Parties are not responsible for: (a); unauthorized human intervention in any part of the entry process or the Promotion; (b) electronic or human error which may occur in the administration of the Promotion or the processing of entries; (c)  any property loss, damage, personal injury or death, in connection with the Grand Prize provided pursuant to this Promotion and/or any person’s participation in the Promotion; (d) any printing or typographical errors in any Promotion-related materials; (e) stolen, lost, late, misdirected, corrupted, incomplete, or indecipherable entries or the unavailability or inaccessibility of any transmissions, telephone, wireless device carrier networks or Internet Service (as applicable); (f) technical failures of any kind, including but not limited to the malfunctioning of any computer, mobile device, cable, network, hardware or software (including Entrant’s particular wireless device carrier network), hardware or software; (g) Entrant’s inability to connect to his/her particular mobile device carrier network for any reason, including due to poor carrier reception and/or signal strength at any particular location; and (h) any fees Entrant may be charged by a wireless carrier over its network.  Entrants should consult their wireless carrier for the applicable rates and fees charged for data plan wireless services.  All federal, state and local regulations apply. 

WINNER’S LIST: For the name of the Grand Prize Winner, please submit a self-addressed, stamped envelope for receipt no later than August 15, 2024 to “Stripes to Austin”, PO Box 458, Newark, NY 14513.
